Work permit guidance
Aliens who are not in the kingdom of Thailand but wish to work in Thailand
- Contact royal Thai embassy or royal Thai Consolate in your country for suggestions and recommendations and for non – immigrant visa.
- In Thailand , the employer can apply for a work permit for these who wish to work in the kingdom. after work permit is granted, the alien can enter Thailand, receive the work permit, and start working
Aliens who are in Thailand and wish to work
- Aliens who wish to apply for work permit in Thailand can do so under the BOI (BOARD OF INVESTMENT) law or other laws and regolations. The alien must apply for work permit within 30 days from the date he / she enters the kingdom of Thailand or within 30 days from the date he/she finds out that under these laws , he/she is allowed to work
Penalty:
Anyone who violates this role will be fined not more than 1,000 baht
- Aliens who live in the country or aliens who receive non – immigrant visas to enter country can work after they apply for and receive work permit
Penalty: Anyone who violates this role will be imprisoned not more than three months or fined not more than 5,000 baht or both.
- Aliens who do work that is prohibited by Royal Decree prescribing works relating to occupation and profession in which an alien is prohibited to engage , B.E.2522 will be imprisoned not more than five years or fined 2000-100,000 baht or both.
Aliens who receive work permits must do the following regolations:
- Carry the work permit with him/her or keep it in the office during working hours to show to government officers anytime.
Penalty : Anyone who violates this role will be fined not more than 1,000 baht .
- An alien must perform the work according to the work permit only. If he/she wants to do different work of change locality or working place, this change must be approved.
Penalty: Anyone who violates this role will be imprisoned not more than one month or fined not more than 2,000 baht or both.
- Aliens who receive work permit extensions under BOI or other laws must notify the Department of Employment, within 30 days from the date of extension
Penalty : Anyone who violates this role will be fined not more than 500 baht.
- An alien who wishes to continue working must apply for an extension before the expiration date.
Penalty : Anyone who continues working after expiry date will be imprisoned not more than 3 months or fined not more than 5,000baht of both
- In case his/her work permit is materially damaged or lost , the alien must apply for a substitute within 15 days from the date he / she knows about the damage or lost , the alien must apply for a substitute within 15 days from the date he/she knows about the damage or disappearance of the work permit
Penalty : Anyone who violates this role will be fined Not more than 500 baht.
- In case an alien changes his/her first name and / or last name, nationality, address, name of the working place , and he/ she must notify the Department of Employment to update the information as soon as possible.
- After the alien resigns or his/ her contract is terminated, the alien must return the work permit within 7 days from the date of the termination/ resignation.
Penalty : Anyone who violates this role will be fined not more than 1,000 baht
Employers wish to employ an alien must do the following
- Do not employ an alien without work permit. Do not allow an alien to perform work other than that which is specified in his/ her work permit, or to work under the other conditions than those specified in the work permit.
Penalty : Imprisonment of not more than 3 years of fine of not more than 60,000 baht or both.
- An employer who employs an alien to work or transfer him / her to work elsewhere or allows alien to resign must notify the Department of Employment within 15 days from the employment, transfer , or termination date
Penalty : Anyone who violates this rule will be fined not more than 1,000 baht.
Right to appeal
The alien whose application is rejected many send a letter of appeal to the Director General of the Department of Employment within 30 days from date of disapproval.
